This Privacy Policy document describes our data and privacy practices for the information that is collected and recorded by R/C Theatres Management LLLP, its subsidiaries, licensees, and affiliated companies (collectively, “RC Theatres”, “Company”, “we”, “our”, or “us”), or that you may provide through our website, www.rctheatres.com, or any other website, product, feature, social media site, or service operated by the Company that posts or provides this policy, participation in the RC Rewards program, or any sweepstakes, promotion, or survey offered by us, disclosure of personal information to us through any other means including written or electronic communication (collectively, the “Site”), and by RC Theatres offline, which we may combine with online data. 

If you have additional questions or require more information about our Privacy Policy, do not hesitate to contact us.

By accessing, using, submitting data to, or otherwise interacting with our Site or providing information to us, you hereby consent to our data practices described in this Privacy Policy.  Please also review our Terms of Use, which also applies to your use of the Services. If you do not agree to the terms of this Privacy Policy and the Terms of Use, please do not use the Services or provide personal data to us. 

There may be times when you are interacting with us when we provide additional information or ask your consent for certain data processing. These additional disclosures supplement this policy and will apply to that feature or functionality.

1. Personal, Sensitive, and Non-Personal Data We Collect

We collect data about users of the Site directly, automatically when you visit the Site, and sometimes from third parties. Some of this data may be considered “personal information” or “personal data”, and some of which may be considered “sensitive”, under various applicable laws. We will also treat other information, including IP addresses and cookie identifiers, as “personal data” where required by applicable law and we will treat certain personal data as “sensitive data” as required by applicable law.

Note that we may de-identify or pseudonymize personal data so that it is non-personal, such as aggregating (such as combining it with data about other individuals) and/or or converting it to a code, sometimes using a function commonly known as “hash”, or otherwise removing characteristics that make the data personally identifiable to you. We maintain and use de-identified data without attempting to re-identify it, except where permitted by applicable law, such as to determine whether our de-identification processes satisfy legal requirements. We will treat de-identified or pseudonymized data as non-personal to the fullest extent allowed by applicable law. If we combine non-personal data with personal data, then we will treat the combined information as personal data under this Privacy Policy.  

Personal Data You Provide to Us Directly

We may ask you to provide data directly, such as contact data (your name, email address, phone number, postal address), and any other data about you (for example, the contents of the message and/or attachments you may send us, your birthday, account information, preferences, and interests).

Payment Information. When you make a purchase, we collect payment data, such as credit card, billing, and other financial information, and information about your transaction history. We may use third party payment processors. 

User Content and Submission Features. The Site may permit you to submit or post photos, audio, video, text, files, social media posts, or other content (“User Content”) through interactive or other features, such as reviews, ratings, or promotional activities (“Submission Features”). Your submission of User Content is subject to the Terms of Service for the Site which give us the right to use your User Content, online or offline, in connection with our promotional activities. Personal information, such as your name, user name (from the Site or your social media account), or where you reside, may be publicly displayed with your User Content. Others may access it, use it, and share it. We are not responsible for how others use User Content you submit or post. In addition, In connection with certain activities, your personal information may be disclosed publicly, for example, being identified as a winner of a sweepstakes or being awarded a prize.

You acknowledge that if you choose to post any information about your viewing history on a third-party platform, or by liking or sharing any content, the Video Privacy Protection Act of 1998 (18 U.S.C. § 2710) (or any similar state law) does not apply. However, to the extent it does apply in any manner, you are providing your informed, written consent to the disclosure of that information pursuant to the Video Privacy Protection Act.

Data We Collect Automatically when You Access or Use the Site

Cookies, Pixels, Tags, and Other Technologies. RC Theatres and our third-party business partners (including any third-party service providers or third-party content, advertising, and analytics providers) may use a variety of technologies, including cookies, pixel tags, and web beacons, that automatically or passively collect information on your access, usage, and other interactions with the Site (“Device ID/Interaction Information”).

Device ID/Interaction Information may include, but is not limited to:

  • Internet protocol (IP) addresses, mobile device identifier, browser type, Internet Service Provider (ISP), and other unique identifier
  • Device information, including device model, date and time stamp, operating system version, mobile network information
  • How you use and interact with the Site, including your search terms, referring/exit pages, the number of clicks, content you view and add to your cart, time of your last interaction, time spent on the Site, and your preferences through a unique visitor ID 

Device ID/Interaction Information may be collected through the use of the following technologies: 

  • Cookies and Local Storage. Cookies and local storage are text files placed within a browser on a device when it is used to visit the Site. Certain web browsers and browser add-ons may provide additional local data storage mechanisms. These cookies and similar technologies may be used to help keep your information use of the Site more secure, store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited, optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information and to recognize you when you return to the Site, to study traffic patterns on the Site, to study the effectiveness of our customer communications, to maintain the integrity of the Site, to measure crash analytics and other maintenance related data, and to manage and measure the performance of advertisements displayed on or delivered by or through the Site.
  • Most browsers provide you with the ability to disable, decline, or clear cookies and local storage through your individual browser options. To know more detailed information about cookie management with specific web browsers, it can be found at the browsers’ respective settings. However, if you disable cookies, you may find this affects your ability to use certain parts of the Site. For more information about cookies, please visit https://www.aboutcookies.org.
  • Pixel Tags. Small graphic images or other web programming code (also known as web beacons or pixel tags or 1x1 GIFs or clear GIFs) may be included in our web pages and email messages. These and similar technologies may be used for a number of purposes by us and our third-party providers, including to count visitors to the Site, to monitor how users navigate Site, to count how many of our email messages were opened, or to count how many particular products were viewed, or for marketing and targeted advertising purposes. The data we collect through this technology may include the first date and time you open our email, and whether you click any links included in our email.
  • Embedded Scripts. An embedded script is programming code that is designed to collect data about your interactions with the Site, such as the links you click on. The code is temporarily used by our server or a third-party service provider or business partner while you browse or interact with the Site and is deactivated or deleted when you disconnect from the Site.
  • Session Replay Technology. RC Theatres may record through session replay technology your interactions with the Site, such as what pages you visit on the Site, how long you visit those pages, and any links you click or data you provide.  We use this data for our internal business purposes, such as for website analytics, to improve the Site and our products and services, and to address functionality issues.  

Approximate Location Data. In some cases, we may directly collect approximate location data through your device if you have opted in to the collection of that data. You may be able to turn off the collection of location data through the settings on your device. However, please note that we may still be able to collect or infer your approximate location through other data we collect, such as IP address. In addition, some mobile service providers may also provide us or our third-party providers with data regarding the physical location of the device used to access the Site.

Data We Collect from Third Parties

Enhancement Data. We may receive data about you from other third parties, such as data aggregators, joint marketing partners, third party websites, service providers and other business partners. We may also supplement the data we collect with outside records from third parties, such as public databases, publicly available social media pages, and third parties who enhance the data we have about you, in order to provide you with information or services you have requested, to tailor content, to offer you opportunities to purchase products or services that we believe may be of interest to you, and for other purposes. The data collected and stored by third parties is subject solely to the third party’s privacy practices.

2. How We Use Data

We may use the information we collect about you or that you provide to us, including personal information and Device ID/Interaction Information in various ways, including:

  • To provide, operate, and maintain our website, such as to enable you to use the Site; create and manage your account information; process your purchases and fulfill orders; send order and account-related communications, such as receipts and confirmations; respond to your questions, complaints, or comments and ask for your feedback; process information you provide to us; provide customer service and support;  facilitate your participation in sweepstakes, contests, and other promotions; and develop new products, services, features, and functionality.
  • To improve and personalize your experience, such as to identify your interests and preferences and tailor the content, recommendations, and advertising we display to you or others, on the Site and elsewhere, including as described in the section titled “Third Party Advertising and Analytics Third Parties and Similar Third Parties”.
  • For internal business purposes, such as to understand and analyze how you use our website; to improve the overall content and experience of our Site; facilitate your job application; detect and troubleshoot problems; analyze the effectiveness of our marketing efforts; analyze trends, statistics, and usage patterns; market research; conduct sales auditing; comply with legal requirements and our business policies and practices, such as our recordkeeping, backup, and document retention policies.
  • For administrative purposes, such as to communicate with you, either directly or through one of our partners, including for customer service, to provide you with updates and other information relating to the website, such as changes to our Site or any products or services we offer or provide through it, changes to our Privacy Policy, Terms of Service, or other policies; verify your identity, including that your email address is active and valid; contact you regarding your use of the Site, content, features; or other administrative matters.
  • To send marketing messages, such as to send you information about us and other third parties by email, mail , push notification, or other means, including to send you information about films, events, and offers, or other information about tickets or merchandise you have shown interest in to send you cart abandonment notifications, and for other marketing and promotional purposes.
  • For Security, such as to detect, investigate, protect against, and prevent misuse of our systems, fraud, crime, or other illegal activities that violate our policies or the law.
  • For legal purposes, such as to resolve legal disputes; carry out our contractual obligations; enforce our rights arising from any contracts entered into between you and us, including for billing and collection; enforce our policies; cooperate with government or other legal inquiries; fulfill regulatory reporting obligations; protect ours or others’ rights or interests, which may include sharing data with other companies, lawyers, courts, or other government entities.
  • In Connection with Business Transitions, such as when evaluating or engaging in a merger, acquisition, consolidation, bankruptcy, or other corporate transition affecting all or part of our assets, including during the course of due diligence.
  • For other purposes as disclosed, such as at the time of collection or otherwise with your prior consent. 

3. Disclosure of Data to Third Parties

We may share the data we have collected about you (including personal data) in the circumstances described below or elsewhere in this Privacy Policy, as disclosed at the time you provide data, or otherwise with your consent. 

Third Party Advertising and Analytics Partners. As fully described in the section below titled “Third Party Advertising and Analytics Third Parties and Similar Third Parties” , we share (or allow third parties to collect) certain data, including about how you use the Site, to target advertising to you and others and assess the effectiveness of our advertising, and for similar purposes. We do not share your personal data with third parties for those third parties’ direct marketing purposes without providing you the ability to consent (opt-in or opt-out). We may share information when you direct us to do so, including when you log in through a third-party application or feature through which information is shared, or if we present you with an opportunity to receive marketing offers from a third party. Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly. If you choose to post information to a third-party platform, that information may be public.

Third Parties Providing Services on Our Behalf. We may share personal information about you with vendors who provide services on our behalf, such as fulfilling orders, providing processing or other information technology services, marketing our services to you on our behalf, carrying out research and analysis, and personalizing your guest experience, site and app development, website hosting, data analytics, product shipping, sending email or other communications, security and fraud prevention vendors, and similar entities. 

Third party integrations/other third parties to whom you agree or direct us to share your data. We may share certain data when you interact with a third party that is integrated in our Site. Please note that we are not responsible for the privacy practices of any third party. If you decide that you do not want to receive communications from a third party, or have questions about their privacy practices, you will need to contact that third party directly. If you choose to post information to a third-party platform, that information may be public. 

Sweepstakes, contests, promotions. We may offer sweepstakes, contests, or other promotions (any, a "Promotion"), that may require registration. By participating in a Promotion, you are agreeing to the provisions, conditions, or official rules that govern the Promotion, which may require specific requirements of you (including, without limitation, and except where prohibited by law, allowing the sponsor(s) of the Promotion to use your name, voice, likeness, or other indicia of persona in advertising or marketing materials). If you choose to enter a Promotion, personal data may be disclosed to third parties or the public in connection with the administration of such Promotion, including, without limitation, in connection with winner selection, prize fulfillment, as required by law or permitted by the Promotion’s terms or official rules (such as on a winners list).

Other users of our services. If you choose to leave a rating, review, or participate in any other feature, we may make certain information about you available to other users of our Site. In such cases, we will share certain information you provide, including your first name, last initial, city, state, and which theater your review is about with our users. 

Administrative and legal purposes. RC Theatres reserves the right to use or disclose any data as needed to satisfy any law, regulation or legal request; to protect the integrity of the Site; to fulfill your requests; to cooperate in any law enforcement investigation, an investigation on a public safety matter, or an investigation into claims of intellectual-property infringement; to protect and defend the legal rights or property of RC Theatres, our affiliates and shareholders, any Site or its users, or any other party; or, in an emergency, to protect the health and safety of our users or the general public. We may also use Device Identifiers to identify users, and may do so in cooperation with copyright owners, Internet service providers, wireless service providers, or law enforcement agencies, in our discretion. 

Business transitions. In the event RC Theatres goes through a business transition, RC Theatres reserves the right to disclose and transfer all personal data related to the Site (including, without limitation, during the course of any due diligence process): (i) to a subsequent owner, co-owner or operator of the Site; or (ii) in connection with a corporate merger, consolidation, restructuring, bankruptcy, the sale of certain of RC Theatres’ ownership interests, assets, or both, or other company change. By providing your data, you understand and agree that we may transfer such data to the acquiring entity without your further consent, except where required by law. 

Employment applications. If you apply for a job with us, we or our service provider(s) may ask you to provide self-identifying information (such as veteran status, gender, and ethnicity) in conjunction with laws and regulations enforced by the Equal Employment Opportunity Commission and other federal, state, and local regulatory agencies. Providing such self-identifying information is voluntary, but if you do provide such information, we and/or our service providers may submit that information to the appropriate government or regulatory agencies to fulfill reporting requirements and use that information to defend against employment-related complaints. Please note that we may utilize a careers portal that is operated by a third party, in which case, your registration and use of the careers portal will be subject to the third party’s privacy practices as disclosed on the portal. Non-personal data. Except as expressly prohibited by law, we may share non-personal data that we collect, such as certain Device ID/Interaction Information, aggregate user statistics, and hashed or otherwise de-identified or pseudonymized data (including email addresses), and/or our analyses derived from such data, with third parties in our discretion, including for targeted advertising purposes. 

4. Third Party Advertising and Analytics Third Parties and Similar Third Parties

We may use third party business partners, such as analytics companies, ad agencies, network advertisers, and others who provide us with data about the Site, users, and our advertisements, and who deliver ads to you on our behalf on the Site and elsewhere online. We and our third-party business partners collect certain data about your visits to and activity on the Site and other websites and services, including as described in “Social Media and Other Third Party Platforms” , and may use this data to target advertising to you and others and to assess the effectiveness of our advertising. We may also share (or permit third parties to collect) certain data, such as Device ID/Interaction Information, aggregated or de-identified, pseudonymized or hashed data (including email addresses), with these third parties for similar purposes.  

These third parties may set and access their own tracking technologies on your device (including cookies, web beacons or other technology) and may otherwise collect or have access to your personal data over time, including about your visits to the Site as well as other websites and online services, some of which may be personal information or personal data under various state laws. Companies that we share data with, including ad agencies and networks, may use the data, often in combination with their existing data, in order to present more relevant advertisements that may be of interest to you, and to help us and third parties to do the same.

  • Cookie Opt-Out Tools. To disable sharing through cookies set by third parties that may be considered targeted advertising under such laws, manage cookie preferences through the link in the footer of the website.
  • NAI/DAA Opt-Out. Some of the companies we use may be members of the Network Advertising Initiative (“NAI”) or Digital Advertising Alliance (“DAA”). The NAI provides information regarding targeted advertising and the opt-out procedures of NAI members, including opt-out mechanisms for web browsers, mobile and other connected devices, and a tool to opt out from participating NAI members using your hashed email address for interest-based advertising. You may also want to visit the DAA's website, which provides information regarding targeted advertising and offers an opt-out for DAA-participating companies.
  • Mobile Device/AppChoices. Mobile devices may contain settings that allow you to disable tracking advertising and/or analytics. In addition, the digital advertising industry has provided the ability for mobile users to register at AppChoices for their intent not to receive targeted advertising.
  • Google Analytics. We use Google Analytics, which uses cookies and similar technologies to collect and analyze data about the use of the Site and report on activities and trends. This service may also collect data about the use of other websites, apps, and online services. You can learn about Google's practices, and opt out of them by downloading the Google Analytics opt-out browser add-on.

Please note that opting out through these mechanisms does not opt you out of being served advertising, and that you will continue to receive generic ads while online. Your opt-out choices are browser and device specific; if you disable your cookies, upgrade your browser after opting out or if you use multiple different devices, please opt-out on each device and each browser separately.

5. Social Media & Other Third-Party Platforms

The Site may permit or facilitate interactions with an interactive third-party website or service ("Social Media"), such as enabling you to "like" or "share" content. If you choose to share content or otherwise post information from or via the Site to Social Media, that data may be public, and the third party may have access to data about you and your use of the Site. You may also choose to participate on Social Media in a way that connects that third-party service with the Site (such as posting to one of our pages on a Social Media site). Doing so may allow us to collect (or the third party to share) data about you. These third-party Social Media platforms may be able to collect certain data about your visits to the Site regardless of whether or not you affirmatively interact with the feature and whether or not you are logged into (or have) an account with the third-party platform.

We may also receive data about you if other users of Social Media give us access to their profiles and you are one of their connections or "friends". The data we collect is subject to this Privacy Policy. The data collected and stored by the third party remains subject to the third party’s privacy practices, including, without limitation, whether the third party continues to share data with us, the types of data shared, and your choices with regard to what is visible to others on that third-party website or service. The third party may allow you to remove the application or feature, in which case we will no longer collect data about you through the application or feature, but may retain the data previously collected.

6. Third Party Links & Content

RC Theatres is not responsible for the privacy policies of third parties or other sites, even if they are linked to our Site. RC Theatres includes these links solely as a convenience to you, and the presence of such a link does not imply a responsibility for the linked site or an endorsement of the linked site, its operator, or its contents. Please make sure you read their privacy policy before using those sites when you leave our Site.

7. Your Choices

Marketing Messages from Us. You may opt-out of marketing communications as set forth below.

  • Email. You may unsubscribe from marketing emails we send you through the opt-out mechanism included in each such email. Note, however, that we reserve the right to send you certain communications relating to your use of the Site, notices of changes to this Privacy Policy or other terms, or similar administrative and transactional messages.

Updating Your Information. You are responsible for maintaining the accuracy of the data you submit to us, such as your contact data. You may update the data you have provided to us by logging into the "My Account" setting or similar page on the Site. 

Data Privacy Choices. Certain states provide additional rights. Please see below for information on additional rights you may have.

8. General Audience Site

We encourage parents and guardians to observe, participate in, and/or monitor and guide their online activity.

Our Site is not intended for individuals under the age of 18, and we do not knowingly collect personal information from children under 18. If you think that your child provided this kind of information on our website, we strongly encourage you to contact us immediately and we will do our best efforts to promptly remove such information from our records.

9. Security

RC Theatres uses commercially reasonable steps designed to secure your personal data; however no data transmission over the Internet, wireless transmission, or electronic storage of data can be guaranteed to be 100% secure. RC Theatres cannot ensure or warrant the security of any data we collect. You use the Site and provide us your data at your own risk. 

10. Consent to Transfer

RC Theatres is a company in the US. Please be aware that the data we collect will be transferred to and processed in the United States and other countries. By using the Site, or providing us with any data, you fully understand and unambiguously consent to this transfer to, and processing, usage, sharing, and storage of your data in the United States and other jurisdictions, for which the privacy laws may not be as comprehensive as those in the country where you reside and/or are a citizen.  As a result, this data may be subject to access requests from governments, courts, or law enforcement in the United States and other countries according to the laws in those jurisdictions.  Your data will also be disclosed to third parties as described in the Disclosure of Data to Third Parties section above.

11. Changes to this Privacy Policy

To the extent permitted by applicable law, we reserve the right to change or modify this Privacy Policy at our discretion at any time. We will notify you of material changes by posting the changed or modified Privacy Policy on our Site. We may also provide notice to you in other ways, such as through contact information you have provided. Any changes will be effective immediately upon the posting of the revised Privacy Policy unless otherwise specified. Your continued use of the Site after the effective date of the revised Privacy Policy (or such other act as specified in the revised Privacy Policy) will, to the fullest extent permitted by applicable law, constitute your consent to those changes. However, we will provide notice and obtain your consent (opt-in or opt-out) if required by law. Note that you may need to consent to our new policies to continue using the Site.

13. Notice to Maryland and Virginia Residents

We set forth above the categories of personal data we process, the purpose for processing personal data, the categories of personal data shared, and the categories of third parties with whom personal data is shared. Residents of Maryland and Virginia have certain privacy rights with respect to this data, as described below.

If you are a Consumer residing in Maryland or Virginia and would like to exercise your applicable rights, please email privacy@rctheatres.com.

  • Access Your Personal Data/Data Portability – To confirm whether we are processing your personal data and request to access such data, please follow the instructions above. Where required by law, this includes to obtain a copy of the personal data we hold about you and, where permitted by applicable law and to the extent feasible, in a readily usable format to allow data portability. You also have the right to request a list of categories of third parties with whom we have specifically shared your personal data.
  • Delete Your Personal Data – You may submit a request to delete your personal data.
  • Correct Your Personal Data – You may submit a request to correct the personal data we hold about you.
  • Opt-Out of Sales of Your Personal Data and Targeted Advertising – You have the right to opt out of the sale of your data. RC Theatres does not sell personal data to third parties for monetary compensation, however sharing of IP addresses or mobile ad IDs with third party advertising vendors and certain other targeted advertising practices may constitute a “sale” under applicable law. Please note that opting out of sales and targeted advertising will not opt you out of all advertising. To opt-out of the sales of your personal data please follow the instructions above.
    • Cookie-Based Opt-Outs for Sale and Targeted Advertising – RC Theatres engages in online advertising practices (and certain analytics or similar activities) that may be considered “targeted advertising” under Maryland and Virginia law. To disable sharing through cookies set by third parties that may be considered targeted advertising under such laws, manage cookie preferences through the link in the footer of the website. Please also review the Third Party Advertisers and Analytics and Similar Third Parties section above for information on industry tools and device settings that may be available to you.
    • Authorized Agents Submitting Opt-Out Requests for Sales and Targeted Advertising – If you are an authorized agent submitting a request to opt out of sales or targeted advertising on behalf of a Maryland or Virginia resident, please submit the request pursuant to the above instructions. 
  • Right to Appeal – If, for any reason, you would like to appeal our decision relating to your request, you have the right to submit an appeal and can do so by emailing privacy@rctheatres.com. Please include your full name, the basis for your appeal, and any additional information to consider.
  • Sensitive Data – If you are a resident of Virginia or where otherwise required by applicable law, we will obtain your consent to the processing of any Sensitive Data (as defined by the applicable state law) we collect. If you wish to opt out of our processing of your Sensitive Data (as defined by the applicable state law), please email us at privacy@rctheatres.com. 
  • Opt-Out of Profiling – in furtherance of legal or similarly significant effects – RC Theatres does not process your personal data for the purposes of profiling in furtherance of decisions that produce legal or similarly significant effects defined under these state privacy laws.
